Legal Documents
CC&R's
CC&R’s are the rules that govern planned communities and are enforced by HOA’s. CC&R’s tell you what you can and can’t do with your property. CC&R’s cover restrictions concerning things such as property appearance, parking rules, noise and nuisances, rental restrictions, pet rules, etc. CC&R’s also cover how HOA’s can enforce these rules, such as notices, fines, lines, etc.
Bylaws
Bylaws are legal documents that govern how a Homeowners Association operates. They cover rules related to the Board of Directors, day-to-day operations, election guidelines, meeting structure, dues management, and community budget.
Articles of Incorporation
Articles of Incorporation for a homeowners association (HOA) are essential documents filed with the State to establish the HOA as a nonprofit organization. These documents are crucial for the legal operation and governance of the HOA.
Idaho HOA Act
In Idaho, homeowners associations (HOA’s) are regulated by the Idaho Homeowners Association Act. The act governs the operation, management, and rights of homeowners and neighborhoods that are a part of a homeowners association in Idaho. The act also has requirements for HOA meetings and financial disclosures.
